LG Leipzig: Liability of online traders for representational errors on eBay
According to a ruling handed down by the Regional Court of Leipzig (Landgericht Leipzig, LG Leipzig) on 16.12.2014 (Case 1 HK O 1295/14) an online trader is also liable for default if, due to a technical error on the eBay vendor site, representation of his legally required disclosures is insufficient.
Practical tip: Following the current ruling online traders will be unable to avoid not only making the legally required disclosures to their full extent when offering their goods via online marketplaces but should also monitor to the best of their ability whether representation of these disclosures functions without technical errors. Representation errors on just a single browser can result in a legal claim on the trader.
