This Thursday, the Higher Regional Court of Munich discussed a claim by GEMA against YouTube.
Since 2009 GEMA tries to obtain per streams minima as damages from YouTube. Unsuccessfully thus far also in a second instance of the Munich courts. GEMA claims 0.375 EUR per respective stream, justifying this with the service's enormous advertising revenue.
YouTube argued to only act as host provider, not actively providing content. It would act as platform for its users only, not be responsible for their content. The case will likely be appeal es and heard by the Federal Court of Justice. At least. The underlying issue busies national and European legislators as well.
