SKW Schwarz has comprehensive expertise in the insurance business. We represent our clients in court and advise them on insurance law aspects.
Our work focuses on the links between insurance and transport law. The two branches of law are closely connected because all transport damages give rise to issues of insurance protection, the protected interest and the interest of the insurer.
In addition, we represent our clients in and out of court on major personal damage resulting from workplace or traffic accidents. We clarify cover and liability issues and assert claims against the damaging party as well as claims under accident and passenger accident insurances.
Examples
Assertion of damages claims of seriously injured persons
A 15-year-old girl and several other children were persuaded to take a particular “sleigh ride”. A young man tied several old steel tubs to one another and used a Unimog truck to pull them across a snowy meadow. Due to excessive speed the tub in which our client sat toppled over in a curve. She was thrown out, and the following tub hit her so badly on the neck that she suffered a full quadriplegia with almost complete paralysis of all four limbs. We enforced the damages claims denied by the opposing party against the insurance provider of the damaging party. A seven-figure damages payment secured the financial future of our client.
In another case a man was injured in a car accident, with the car being driven by his wife. He was completely paralysed. The couple had been disagreeing at the time, and the wife claimed during the proceedings that, during the drive, our client had forcibly taken the wheel in order to engineer a joint suicide. We took the case up to the Federal Court of Justice (BGH) which ruled that the insurer had to pay damages; our client’s large damages claims were finally settled.
